Please read these Terms carefully before subscribing to Nagisa. By completing a purchase or using the service, you agree to be bound by them.

When you subscribe, you are purchasing from Paddle under their Buyer Terms. Nagisa makes the service available to you under these Terms. Nagisa is a web-based sleep soundscapes service offering streaming and offline access to ambient audio content. It is operated by an independent developer based in Nairobi, Kenya ("Nagisa", "we", "us", "our").
By subscribing, you are entering into two separate agreements: (a) these Terms with Nagisa, governing your use of the service and content; and (b) Paddle's Buyer Terms with Paddle, governing the payment transaction. Both apply to you.

Nothing in the service constitutes medical advice, diagnosis, or treatment. Nagisa does not treat, cure, or make any therapeutic claim regarding insomnia, sleep disorders, anxiety, or any other medical condition. If you have a sleep disorder or any health concern, please consult a qualified medical professional.

Nagisa provides access to 50+ ambient soundscapes for sleep, focus, and meditation via a web application. Key features include:
Access to the service is personal and non-transferable. Sharing your access credentials with others is not permitted. We reserve the right to modify, add to, or remove tracks from the library at any time; material reductions in the library will be communicated in advance.
Nagisa is available on a monthly or annual subscription, billed through Paddle. Current pricing is displayed at checkout and on the main page. Prices may change; we will notify you before any increase affects your renewal (see section 5).
First-time subscribers may be offered a free trial period (currently 7 days) before their paid subscription begins. The trial period and eligibility are displayed at checkout. If you do not cancel before the trial ends, your chosen subscription plan will begin automatically and your payment method will be charged.
Free trials are available once per customer. Creating duplicate accounts to obtain additional trial periods is a breach of these Terms.
Subscriptions renew automatically at the end of each billing period (monthly or annually) for a further period of the same duration, at the then-current price, until cancelled. By subscribing, you authorise Paddle to charge your payment method on a recurring basis.
Paddle will send you a renewal reminder where required by law in your territory.
All payments are processed by Paddle.com, our Merchant of Record. Paddle is a PCI-DSS compliant payment processor. Nagisa never sees, stores, or has access to your card details or billing address — these are held exclusively by Paddle.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain full access until then and will not be charged again after that date.

Cancelling does not automatically generate a refund of any amount already charged. See section 7 for refund eligibility.
Because Paddle is the Merchant of Record, refunds are processed by Paddle in accordance with their Refund Policy and Buyer Terms. Nagisa works with Paddle to honour all valid refund requests.
First-time Nagisa subscribers may request a full refund within 14 days of their first payment, no questions asked. This applies once per customer account regardless of plan.
If you are a consumer in the EU or UK, you have a statutory right to withdraw from a digital content purchase within 14 days of completing the transaction, without giving a reason, under applicable consumer law. However, if you started streaming or using the service during that 14-day period, and you expressly agreed at checkout for delivery to begin immediately, your right of withdrawal may be reduced or lost as permitted by law. Our 14-day guarantee above is offered alongside — and does not limit — any statutory rights you may have.
Paddle will issue a refund in the following circumstances regardless of the above:
Email nagisa.support@gmail.com with your email address used at checkout, the charge date, and a brief description. You may also contact Paddle directly at paddle.net. Approved refunds are returned to your original payment method within 5‐10 business days.
We encourage you to contact us or Paddle before raising a chargeback with your bank, as this typically results in faster resolution. If you raise a chargeback that we reasonably believe constitutes fraud or abuse (for example, claiming non-delivery of a service you have accessed), we reserve the right to suspend your access while we investigate, and to permanently block access if fraud or abuse is confirmed. Paddle will provide evidence to your bank or card issuer in all such cases.
You agree not to:
We reserve the right to suspend or terminate your access without refund if these obligations are breached. You may cancel your subscription at any time (see section 6); termination of access following cancellation takes effect at the end of your billing period.
All audio content, artwork, and associated materials made available through Nagisa are owned by or licensed to Nagisa and are protected by copyright and other applicable intellectual property laws. Your subscription grants you a personal, non-exclusive, non-transferable, revocable licence to access and listen to the content for personal, non-commercial purposes only.
No ownership of any content is transferred to you by subscribing. You may not reproduce, redistribute, broadcast, publicly perform, sell, or use any content for commercial purposes without prior written consent.
The Nagisa name, logo, and branding are proprietary to Nagisa. Paddle's checkout interface, branding, and associated materials are owned by Paddle and are governed by their terms.
Nagisa is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no representations or warranties of any kind, express or implied, including but not limited to:
Nothing in these Terms affects any non-excludable warranties or statutory rights that apply in your territory.
Nothing in these Terms excludes or limits our liability for: fraud or fraudulent misrepresentation; death or personal injury caused by negligence; or any other liability that cannot be excluded by law in your territory.
To the fullest extent permitted by applicable law:
We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address associated with your Paddle account) or by a prominent notice in the app, and will specify when the new terms take effect. If you continue using the service after the effective date, you are deemed to have accepted the updated Terms. If you do not accept a material change, you may cancel your subscription before the effective date.
We reserve the right to modify, add to, or discontinue features of the service. We will provide reasonable advance notice of any discontinuation of the service as a whole.
Unless mandatory consumer law in your country of residence provides otherwise, these Terms and any dispute arising out of them are governed by the laws of Kenya. We will always try to resolve any dispute informally first — please contact us at nagisa.support@gmail.com before initiating any formal proceeding.
For disputes relating to payment, billing, or refunds, you may also contact Paddle directly at paddle.net or help@paddle.com, as Paddle's Buyer Terms contain additional jurisdiction-specific dispute resolution provisions (see section 15 below).
Paddle's Buyer Terms contain mandatory country-specific provisions that apply to consumers in certain jurisdictions. These apply to you in addition to these Terms with respect to the payment transaction. Key provisions include:
You have the right to withdraw from the transaction within 14 days of purchase for any reason. If you started using the service during that period and consented to immediate access at checkout, your right of withdrawal may be limited as permitted by applicable law. Nothing in these Terms limits your mandatory statutory consumer rights. For disputes, you may bring a claim in the courts of your country of residence.
For payment-related disputes with Paddle, the laws of the State of New York apply, unless mandatory consumer protection laws in your state provide greater protections. You have the right to opt out of certain class action and jury trial waivers in Paddle's Buyer Terms by emailing help@paddle.com within 30 days of your transaction.
If Nagisa breaches an essential contractual obligation, our liability for payment-related claims via Paddle is not excluded and is limited to the foreseeable damage typical for this type of agreement, in accordance with Paddle's Buyer Terms.
For payment-related disputes with Paddle, the law of Quebec applies and the courts of Quebec have jurisdiction. A French version of Paddle's Buyer Terms is available at paddle.com/legal/buyer-terms-fr.
Access to Nagisa is tied to the email address used at checkout with Paddle. To sign in on a new device or after signing out, you enter that email in the sign-in form on the main page; we verify it against Paddle's records in real time and grant access only if an active or trialing subscription is found. No password is used or stored by Nagisa.
Each Nagisa account may be signed in on a maximum of 3 devices simultaneously. If you attempt to sign in on a fourth device, you will be shown a list of your currently registered devices and asked to remove one before continuing. You can manage your signed-in devices at any time via the Manage Devices option inside the app. Signing a device out does not cancel your subscription or delete any listening data — it simply frees up a device slot.
Your in-app data — favourites, listening history, play counts, weekly sessions, and preferences — is stored locally on each device using your browser's localStorage. This data is not synced to our servers and does not follow you between devices. Each device maintains its own independent history. You can delete this data at any time by clearing your browser's site data for nagisa-app-lac.vercel.app. See our Privacy Policy for full details.
You are responsible for maintaining control of the devices on which you are signed in to Nagisa. If you believe your account has been accessed without your authorisation, contact us at nagisa.support@gmail.com immediately.
